Customer agrees when using, or accessing Goldenbeaverhosting.com services that the following Terms will be met

Agreement
Goldenbeaverhosting.com may modify these terms upon notice published online via goldenbeaverhosting.com. User’s use of goldenbeaverhosting.com services after such notice shall constitute user’s acceptance of the modifications to this Agreement. This agreement, User account, contract, and billing will automatically renew unless cancelled in writing prior to the renewal date.
Acceptable usage policy
User agrees to use the service in manner consistent with any and all applicable laws. In the event that this account is not used in accordance with all Applicable Laws including, but not limited to Local, State or Federal Laws, goldenbeaverhosting.com reserves the right to cooperate with all or any law enforcement agencies.

User agrees to follow the Acceptable Use Policy of any network user connects to, including GoldenBeaverHosting.com system.

Neither goldenbeaverhosting.com nor its Information Providers are responsible for any damages arising from User’s use of goldenbeaverhosting.com or by User’s inability to use goldenbeaverhosting.com service.

goldenbeaverhosting.com services may not be used to transmit or originate any material that harasses or threatens, encourages bodily harm, or destruction of property. Use of the goldenbeaverhosting.com service to collect, or attempt to collect, personal information about third parties without their knowledge or consent is prohibited.

Adding, removing, or modifying identifying network header information in an effort to deceive or mislead is prohibited. Attempting to impersonate any person by using forged headers or other identifying information is prohibited. Use of the goldenbeaverhosting.com service to make fraudulent offers to sell or buy products, items, or services, or to advance any type of financial scam such as “pyramid schemes” and “chain letters” is prohibited.

Use of the goldenbeaverhosting.com service for any activity which affects the ability of other people or systems to use goldenbeaverhosting.com Services or the Internet is prohibited. This includes “Denial of Service” (DoS) attacks against another network host or individual user. Interference with or disruption of other network users, services or equipment is prohibited. It is the Member’s responsibility to ensure that their network is configured in a secure manner. A Subscriber may not, through action or inaction, allow others to use their network for illegal or inacceptable actions. A Subscriber may not permit their network, through action or inaction, to be configured in such a way that gives a third party the capability to use their network in an illegal or inacceptable manner. Unauthorized entry and/or use of another company and/or individual’s computer system will result in immediate account termination. goldenbeaverhosting.com will not tolerate any subscriber attempting to access the accounts of others, or penetrate security measures of other systems, whether or not the intrusion results in corruption or loss of data.

Use of the goldenbeaverhosting.com service to access, or to attempt to access, the accounts of others, or to penetrate, or attempt to penetrate, security measures of goldenbeaverhosting.com or another entity’s computer software or hardware, electronic communications system, or telecommunications system, whether or not the intrusion results in the corruption or loss of data, is expressly prohibited and the offending goldenbeaverhosting.com account is subject to immediate termination.

Intentional distributions of software that attempts to and/or causes damage, harassment, or annoyance to persons, data, and/or computer systems are prohibited. Such an offense will result in the immediate termination of the offending account.

The use of services provided by goldenbeaverhosting.com to transmit any material (by e-mail, uploading, posting or otherwise) that infringes any copyright, trademark, patent, trade secret or other proprietary rights of any third party, including, but not limited to, the unauthorized copying of copyrighted material, the digitization and distribution of photographs from magazines, books, or other copyrighted sources, and the unauthorized transmittal of copyrighted software is prohibited.

goldenbeaverhosting.com has a zero tolerance policy for the use of its network for the posting of messages or commercial advertisements, which violate the rules, regulations, FAQ or charter of any newsgroups or mailing list. Commercial messages that are acceptable under the rules of a newsgroup or mailing list or that are solicited by the recipients are permitted.

Use of the services of goldenbeaverhosting.com to transmit any unsolicited commercial or unsolicited bulk e-mail is expressly prohibited. Violations of this type may result in the immediate termination of the offending customer’s account without warning or reimbursement.

Legitimate uses of bulk email in a manner consistent with United States law may be permitted at the sole discretion of goldenbeaverhosting.com. goldenbeaverhosting.com’s abuse resolution policy is to serve all abuse complaints via our ticket system at https://www.goldenbeaverhosting.com/client/clientarea.php and assure that they are handled professionally. Accounts generating complaints from recognized blacklist databases will incur a one-time administrative fee of $35 per complaint and are expected to resolve these issues themselves. In the event of a Spamhaus or Outblaze blacklist listing, an additional $350 administrative fee will be issued along with immediate termination. Should a contract be involved, the client must immediately pay the remainder of the balance owed between the current date and the end of the term per the original agreement.

Malicious intent to impede another person’s use of electronic mail services or news will result in the immediate termination of the offending goldenbeaverhosting.com account. Forging any message header, in part or whole, of any electronic transmission, originating or passing through the goldenbeaverhosting.com service is in violation of this AUP.

Use of goldenbeaverhosting.com VPS services for the orgination, relay, or support of bulk email is prohibited. Customers are permitted to send transactional emails and use the service for individual email accounts, but the service may not be used for sending commercial email, even if the customer has opted in to such emails. Sending marketing email in any sort of automated fashion is specifically prohibited.

IRC is allowed on goldenbeaverhosting.com’s network. If you are planning running an IRC server, please notify our staff at signup as these machines require special attention. As with any of our servers, illegal activity is not permitted on IRC, and goldenbeaverhosting.com will reserve the right to terminate accounts without refund if it appears such activity is being conducted. goldenbeaverhosting.com reserves the right to determine if or if not there is illegal activity being conducted in such an instance.

Adult content is allowed, contingent upon compliance with all U.S. regulations, as well as the regulations of the location of the customer’s residency. What sexual content is acceptable on our servers will remain at the sole discretion of goldenbeaverhosting.com, and no other parties.

goldenbeaverhosting.com subscribers will be held responsible and accountable for any activity by third parties, using their account, that violates guidelines created within the Acceptable Use Policy.

Using the server plans to host a content delivery network or content distribution network is not permitted without prior authorization. Using server plans to host applications that produce artificially high bandwidth usage patterns (including, but not limited to software such as SETI@Home and Folding@Home, digital currency mining, and public software mirrors is prohibited without the prior consent of goldenbeaverhosting.com. Please contact sales (at) goldenbeaverhosting.com (dot) com before signing up. Failure to contact goldenbeaverhosting.com may result in your server being rate-limited or turned off.

User hereby agrees that any material submitted for publication on goldenbeaverhosting.com through user’s account(s) does not violate or infringe any copyright, trademark, patent, statutory, common law or proprietary rights of others, or contain anything obscene or libelous. User’s may not host any hardcore adult content on our servers. Software intended to facilitate any such violations or infringements may not be stored on goldenbeaverhosting.com.

The following violations of “netiquette” are grounds for immediate suspension of service pending investigation by goldenbeaverhosting.com and will result in termination of the account(s) the investigation determines to have originated or transmitted these types of traffic.

GoldenBeaverHosting.com reserves the right to monitor network usage, and if a service significantly exceeds average usage, to throttle the available speed to conserve network resources. This will generally not include short spikes in usage, but will include, but not be limited to, sustained transfers of significantly larger than average amounts of bandwidth. If at any time any client’s data transfer rate affects other goldenbeaverhosting.com clients, goldenbeaverhosting.com reserves the right to throttle the service causing such a problem.

GoldenBeaverHosting.com strongly advises the client to regularly perform a backup of their own data, hosted with us. In the unfortunate event that the client has lost their data hosted with GoldenBeaverHosting.com, will use reasonable endeavors to restore the client’s data; however GoldenBeaverHosting.com will not be responsible for lost data, time, income or any other resource due to faulty backups or non-existent back-ups or any data loss due to faulty hardware. We highly encourage our customers to have their own separate backups if your data is critical to you as no backup method is failsafe therefore we make no warranties.

Abuse of GoldenBeaverHosting.com Staff or Support Personnel: At GoldenBeaverHosting.com, we take pride in providing excellent service to all of our customers. It is our policy always to treat our customers with the highest level of respect and courtesy. In return, we expect the same respect and courtesy from you. If our staff feels that you are consistently engaging in abusive content toward them, or addressing them in a demeaning or rude manner, your account(s) may be suspended and you may be asked to rent services elsewhere. We will issue a refund, if it applies, only for the unused portion of pre-paid service. Abusive conduct includes, but is not limited to, the following behaviors:

  • Repeatedly addressing members of our staff in a demeaning or rude manner. Using profanity in any oral or written communications with our staff, by any medium of communication, including but not limited to e-mail, instant messages, chat, text messaging, fax, postal mail, telephone, voice over Internet Protocol, or in-person communication. Yelling or shouting at our staff. Deliberately using all capital (uppercase) letters in any written communication to our staff; Insulting our staff because of their personal characteristics, or on the basis of their race, ethnicity, national origin, sex, sexual orientation, religion, or housing or economic status; or Deliberately providing false information to our staff for the purpose of harassing them or wasting their time.
Unlimited Usage Policy
Unlimited usage policy and definitions pertain to certain shared hosting or voice servers accounts that may be offered.

GoldenBeaverHosting.com Clients have an access to unlimited disk space and bandwidth. Essentially then, you can use whatever disk space and bandwidth is necessary for your hosting needs. There is no limit on the amount of resources a single client may use with respect to their hosting. Subject to these terms, GoldenBeaverHosting.com makes every reasonable commercial effort to provide its clients with the storage and bandwidth resources required to power their websites or voice servers, as long as the client’s use of GoldenBeaverHosting.com’s services abides with our Terms of Service. Our goal is provide the resources you require for a typical website or voice server that may experience periods of growth, which may result in increasing demands for resources (such as disk space storage or data transfer) without being subject to additional hosting charges.

What is acceptable and appropriate usage?
GoldenBeaverHosting.com hosting is continually investing in technology and support features. Our hosting solution has specifically been designed to serve the hosting needs throughout the world. Since you will be hosting with hundreds of others on our servers in a virtual community, our offerings are really not intended to support large requirements. For that, we recommend purchasing at least a virtual private server.

GoldenBeaverHosting.com hosting is a hosting service, which ultimately means a number of clients’ websites or voice servers are hosted within the same server environment. To ensure that our hosting is first-class, reliable, and available to all clients within that server community, an individual customer’s usage cannot adversely affect the performance of other clients’ hosting. We monitor our servers 24/7/365 and in no way can one customer adversely affect the performance of that server. If this happens, we will take preventative measures to ensure that the entire community is protected.

Lastly, our hosting service is intended to host websites or voice servers, not backup or storage facility for user’s data. Using your hosting account primarily as an online storage space for archiving electronic files and images is strictly prohibited.

What is unlimited?
Unlimited disk space: Create a website as large as you like, hundreds or thousands of web pages; you will not be penalized for exceeding any upper or ceiling limit. However, please realize that there are many other users on your server and growing a website very large too fast will impede the performance of that server, as using too many server resources will negatively impact other clients on that server. We will place some constraints on how fast you can grow that website and monitor the server resources closely. The vast majority of our clients’ sites grow at rates well within our rules, however, and will not be impacted.
Unlimited bandwidth and data transfer: GoldenBeaverHosting.com does not set limits on the amount of visitor traffic a website can receive or on the amount of content a customer can upload to their website in any given month. GoldenBeaverHosting.com’s bandwidth and data transfer charges are all inclusive; there are no additional fees based on increased use of bandwidth, so long as the customer abides by the Terms of Service. This rule only comes into play when you use excess server processing power that negatively impacts the performance of the server and provides a bad customer experience in that server community. Minimizing the impact on an individual server’s processing power is key to the overall performance on that server. In the vast majority of cases, if you use the shared hosting service appropriately, visitors to your website will be able to view, download, and add as much content from your site as they wish. However, in certain circumstances, our server processing power, server memory, or anti-abuse controls could limit downloads or access from your site. Violators to the above rule will not be tolerated. You can upload all the content that you require each month subject to the rules as outlined above.
Unlimited hosting space but excessive MySQL files: On most GoldenBeaverHosting.com shared hosting plans, we do not set limits on the amount of disk space or data transfer allowed for an individual customer account, nor do we charge additional fees based on an increased amount of usage, so long as the customer is compliant with our Terms of Service. However, GoldenBeaverHosting.com’s services are designed to host websites and as such, we DO NOT provide unlimited space for online storage, backups, or the archiving of electronic files, documents, log files, etc., and such activity shall result in the termination of the customer’s account(s) without notice. Furthermore, accounts with an extraordinarily large number of files can have an adverse effect on server performance. This includes, but is not limited to, accounts with an excessive number of MySQL/PostgreSQL tables, or of a database size that may negatively impact the performance of our servers. GoldenBeaverHosting.com may request that the number of files/nodes, database tables or total database usage be reduced to ensure proper performance for all clients on that server, or we may terminate the clients account, with or without notice.

Public feedback
We have a zero tolerance policy for posting negative feedback on any public locations about our company and/or our employees before submitting a ticket to our “Suggestions & Complaints” Department to discuss your issue, this will result in immediate account termination without any refund.

Although it is your right to post feedback without discussing your issue with us first, it is undoubtedly unfair and unprofessional not to, which is not the type of client that we want to deal with. We have the utmost respect for all of our clients, and are more than fair with all of our clients. We will do anything and everything possible to keep all of our clients satisfied. But in the unlikely event you are not satisfied, all that we ask is to discuss your issue with our Complaints Department first. For example, if you are the type of person to run to the forums at the first chance you get to complain, please DO NOT SIGNUP with GoldenBeaverHosting.com in the first place.

Furthermore, all of our policies that pertain to keeping information given to us confidential including but not limited to our privacy policy, confidentiality agreement, non-disclose agreement are nullified once you discuss your experience publicly. For example, if you make a negative post in public, then you are waiving your protection of privacy.

Payment issues
User agrees to pay goldenbeaverhosting.com all charges relating to the use of User’s account(s) according to rates and prices stated on said sales order at the time of commencement.

User is responsible for charges at the time the service is used and goldenbeaverhosting.com may apply the amount due to User’s credit card at any time.

Goldenbeaverhosting.com reserves the right to suspend access to service for User’s account(s) upon an indication of credit problems including delinquent payments or rejection of any credit card charges.

Dues must be paid on a timely basis. Dues charges will continue regardless of your use unless and until you notify us via our Client Area that you wish to cancel your service at the end of your billing period.

Credit Card payment: If Customer chooses to pay for services by credit card, Customer grants goldenbeaverhosting.com the right to charge payments to that card on each due date. Customer further agrees not to challenge nor dispute any charge representing hosting payments.

Non-Payment: All payments are due in full at the end of the billing period for the service unless you requested a cancellation. Failure to remit payment for services on the due day may result in suspension of customer services. Failure to remit payment for services within two (2) days, including the due day, may result in termination of the service. All customer data remaining after three (3) days of non-payment will be destroyed for security and privacy purpose.

Late Fees: Failure to remit payment for a VPS (Virtual Private Server) on the due day may result in a $5.00 late fee.

Payment Reminders: It is the customer’s sole responsibility to make sure that due’s are paid on time and the email address on file is working and allowed to receive reminders from PayPal.com or GoldenBeaverHosting.com. Once a payment reminder dispatched from PayPal.com or GoldenBeaverHosting.com it is considered as a valid payment reminder. PayPal.com or GoldenBeaverHosting.com does not take any responsibility for non deliverable email addresses or e-mail’s sent by PayPal.com or GoldenBeaverHosting.com. not reaching the client destinations, including but not limited to spam filters or network issues.

Situations of refunds
Without waiving any of its other rights under this Agreement, GoldenBeaverHosting.com offers to its Customers a 5-day money-back guarantee for voice server hosting and a 30-day money-back guarantee for web hosting. If for any reason you cancel your account within these days starting from the day GoldenBeaverHosting.com dispatch your welcome email including your account information or the day you place the order with us, whichever comes first. GoldenBeaverHosting.com will refund your money with no questions asked; provided, however, that you have never previously obtained a refund under the Guarantee. If you have ever previously obtained a refund under one of these Guarantees, your account will be canceled, but no money will be refunded to you.

Changes to your service, including, but not limited to, adding new services, removing services, or changing the type of hosting plan you have do NOT make you eligible for an additional Guarantee. The 5-Day Guarantee applies to your first order of voice server hosting and 30-day money-back guarantee for your first order of web hosting services from GoldenBeaverHosting.com and does not apply to any changes to your service at any time.

Our refund policy does not apply to any additional items or services, this includes but not limited to overage fees, VPS (virtual private servers), domain names or SSL certificates.

Account cancellation
Customers may voluntarily cancel their account at any time, for any reason or for no reason, by opening a ticket to our Billing Department with required details. GoldenBeaverHosting.com requires a five (5) day cancellation notice prior to the due day for discontinuance or downgrades of month to month services. Failure to supply the requisite five (5) days will result in a full billable monthly cycle prior to cancellation. All due amounts must be settled in full before we cancel the customer account. Customer understands and agrees that GoldenBeaverHosting.com does not provide pro-rated or any other kinds of refunds on cancellations. All fees Customer has paid shall be non-refundable, unless stated otherwise under our money back guarantee.

All cancellation requests must be made directly to GoldenBeaverHosting.com, Billing Department by opening a ticket from our Client Area. Cancellations requests are not accepted by email, postal mail or by phone. If a customer canceled a recurring order by contacting any 3rd parties, we will consider it as an account cancellation request. In such cases, GoldenBeaverHosting.com reserves the right to terminate the customer account with immediate effect with or without any prior notice.

Service level agreement
Customers are responsible for the upkeep of their servers. If your server is down, please notify us as soon as possible. We may be reached by submiting a support ticket in our Client Area or by our live chat system. We monitor our network system to ensure that all machines running servers stay up 24 hours a day, 365 days a year, but since we do not monitor servers on an individual basis, you must notify us if your server crashes, etc.

Goldenbeaverhosting.com do not limit file transfer or the amount of data transfered onto the server as long as there is no abuse and it does not interfere with the proper functioning of the server. You are not allowed to upload files that may harm our systems. Customers are aware that their server is not a backup or file sharing system, any files uploaded to their server may be lost at any time. While there is very little chances that we lose data, goldenbeaverhosting.com is not responsible for any loss of data or corrupted files onto the server. Customers are responsible to keep their files in a safe location in case they would need to re-upload these data to their server.

While there is little chance that this could happen, Goldenbeaverhosting.com reserves the right to delete any files uploaded to the server in the case of an emergency to free up space on the server.

Goldenbeaverhosting.com will patch your voice server as needed by the voice server designers at no extra charge. Voice servers are set up with the base install according to the Voice server type ordered.

Goldenbeaverhosting.com do provide a protection against Distributed Denial Of Service (DDoS) attacks. This feature is intended to prevent the service to be inaccessible during a DDoS attack. The illegitimate qualified traffic is rejected upstream in the server, allowing legitimate users to access the server despite the undergoing attack. This is a protection from a wide array of DDoS attacks. Due to the great complexity of this protection, Goldenbeaverhosting.com is not subject to any obligation. It is possible that the attack is not detected by the tools in place, and that the tools developed do not prevent the operation of the service to be interrupted. Throughout the duration of mitigation, Goldenbeaverhosting.com cannot guarantee the availability, accessibility and latency of the server but will try to limit the impact of this attack on the server. If, despite the activation of mitigation, the attack is likely to jeopardize the integrity of the main server and then affect other Goldenbeaverhosting.com clients, Goldenbeaverhosting.com reserves the right to strengthen its protective measures and to isolate any client targeted by these attacks on an alternative server to protect other Goldenbeaverhosting.com clients.

1. Voice Server
Goldenbeaverhosting.com guarantees that it’s Voice Servers Connectivity services will be available 99.9% of the time. That means your voice server is guaranteed operational 99.9% of the time in any calendar month. In the event such level of service is not provided, as measured solely and only by goldenbeaverhosting.com’s monitoring system, goldenbeaverhosting.com will add a credit to your account, on your demand only. Regardless of the number of outages, all refunds are limited to one month’s hosting service fees and do not include excess usage fees or other nonstandard recurring charges.

Goldenbeaverhosting.com do not issue a credit for latency-related issues. We do our best to host our Voice Servers on the highest quality machines and bandwidth possible, but since there are many ways to travel over the Internet, it would be impossible for anyone to guarantee Internet ping times.

The amount of the credits are determined by the following table, based on the amount of Server Uptime the network has provided for the month in which a credit is requested.

2. Web Hosting
Goldenbeaverhosting.com offers a 99.9% Uptime Guarantee. That means your web site is guaranteed operational 99.9% of the time in any calendar month. Regardless of the number of outages, all refunds are limited to one month’s hosting service fees and do not include excess usage fees or other nonstandard recurring charges.

The amount of the credits are determined by the following table, based on the amount of Server Uptime the network has provided for the month in which a credit is requested.

To receive a credit, simply submit a ticket in our Client Area to the Billing Department with the title “Credit” along with the following info. Each request in connection with this must include the dates and times of the Downtime, the name and IP address of the server or servers which experienced the Downtime. The request must be received by goldenbeaverhosting.com within 5 business days after the incident of Downtime. If the unavailability is confirmed by goldenbeaverhosting.com, credit will be applied to your account within 5 days of receipt of your credit request.

You may not use the goldenbeaverhosting.com services in any way to advertise or promote any competitors of goldenbeaverhosting.com

Goldenbeaverhosting.com reserves the right to inspect any server to ensure they are not exceeding the maximum user limit allowed for that server. Violations could result in termination of the service.

Money back guarantee

Affiliates needs to reach a minimum payout amount of $5 before making each withdrawal. A partnership is always based on a quarterly basis, after that 3 months have passed, we always reassess the value of the partnership and then we decide if it is worth to continue the partnership. Goldenbeaverhosting.com reserves the right to revoke, cancel, or terminate any partnership at any time without prior notice.
